UK Deed Poll Office is a trading name of Sutton Dunford & Co. Ltd. which is incorporated in England with company number 7915932. Reg. office: 3rd Floor, 36 Langham Street, London, W1W 7AP. Our address for regular correspondence is 314 Regents Park Road, London, N3 2JX.
The following terms and conditions represent a contract between you and Sutton Dunford & Co. Ltd. ("us", "we", "SDC", etc.) and by submitting an order through our website (deedpoll.co.uk) or over the phone you signal your full acceptance of them. This agreement binds both you and us as soon as you become a customer. The terms of this agreement may be changed at any time and without prior notice. In the event that this agreement is amended the contract binding us shall remain unaltered and the version of the agreement which was in effect at the time of you placing your order will continue to be in force.
1. Becoming a customer
You shall become a customer of Sutton Dunford & Co. Ltd. when:
- You offer to purchase goods or services from us by submitting an order via our website or over the phone; and
- We respond to your order request, usually by e-mail or text (SMS) message indicating our acceptance of your order.
You shall be deemed to have made an offer to purchase goods or services from us if you submit an order form via our website or by phone and signal your acceptance of these terms and conditions. Payment is not necessary in order for you to have made an offer to purchase goods or services and for a contract to have formed between you and us.
2. Deed poll guarantee
The deed polls we issue are guaranteed to be accepted as proof of your legal change of name by all UK based government entities, private companies and other organisations.
If any UK based government entity, private company or other organisation refuses to accept your deed poll as proof of your change of name you will be entitled, upon production of satisfactory evidence proving the refusal, to a refund of any money paid in relation to your order plus seventy five (75) pounds by way of compensation. This is the limit of our liability.
We reserve the right to request a copy of your deed poll to ensure that you are eligible for a refund under this guarantee.
3. Exceptions to this guarantee
The deed poll acceptance guarantee provided for in section two (2) above shall not apply in the following circumstances:
- If your deed poll was not correctly executed
- If you are changing your name to appear as though you hold a title or rank (e.g. Sir or General)
- If some or all of the information you provided to us as part of your order was false
- If you are a foreign national living in the UK
- If a record holder's parental consent requirements have not been met
- If the record holder need evidence that you've changed your name for all purposes
- If the Identity and Passport Service deem your new name to be in breach of their inappropriate and temporary name change policy.
4. Delivery of goods or services
The time it takes us to deliver the goods or services you have ordered from us under this agreement will vary according to the processing service you select during the order process:
4.1 Standard processing
If you elect to use our standard processing service we aim to process your order within three days.
4.2 Priority processing
If you elect to use our priority processing service we will process your order within two days and dispatch it to you by first class mail. If we fail to process and dispatch your order within the time frame permitted under this agreement you will be entitled to receive a refund of the money paid for the upgraded processing service. This is the limit of our liability.
4.3 Express processing
If you elect to use our express processing service and your order is received between the hours of 6am and 4pm on a week day (Monday, Tuesday, Wednesday, Thursday or Friday, excluding bank holidays) we will process your order and dispatch it to you by first class mail on the same day it is received. If your order is received outside of the time listed above your order will be processed and dispatched by first class mail on the next week day. If we fail to process and dispatch your order within the time frame permitted under this agreement you will be entitled to receive a refund of the money paid for the upgraded processing service. This is the limit of our liability.
5. Combining orders
f you elect to use our express processing service and your order is received between the hours of 6am and 4pm on a week day (Monday, Tuesday, Wednesday, Thursday or Friday, excluding bank holidays) we will process your order and dispatch it to you by first class mail on the same day it is received. If your order is received outside of the time listed above your order will be processed and dispatched by first class mail on the next week day. If we fail to process and dispatch your order within the time frame permitted under this agreement you will be entitled to receive a refund of the money paid for the upgraded processing service. This is the limit of our liability.
6. Delivery to foreign postal addresses
If you provide a foreign address for the delivery of your order we will levy an additional fee which represents the reasonable costs we have incurred for delivering your order to an address outside of the United Kingdom. You authorise us to debit such reasonable fees from your credit/debit card.
7. Payment
Payment for any goods or services purchased must be made within fifteen (15) calendar days of you making an offer to purchase goods or services from us.
Outstanding invoices can be paid in the following ways:
- Calling us to make payment with a credit or debit card
- Sending us a cheque or postal order
- Paying the money directly into our bank account at any NatWest branch.
8. Late payment
If you do not pay for the goods or services you have purchased within the time limit set out in section 7 of this agreement we will send you a reminder to pay by calling you, sending a text message or e-mail, or sending a letter to you by post (the "notification of late payment").
If we do not receive payment within seven calendar days of the notification of late payment being given we will issue a formal demand for payment by post and may add an administration fee of ten (10) pounds to the outstanding balance to cover the costs of sending you the formal demand and the costs incurred while chasing the debt. We may, in addition to the administration fee, charge interest on the outstanding balance at a rate of 8% above the Bank of England base rate per month.
For each letter sent to you after the initial notification of late payment we may also charge you an administration fee of five (5) pounds to cover the costs of preparing and sending the letter.
If the balance remains outstanding despite our reminders to pay, we may instruct our solicitors to write to you demanding payment. If such action is required we may charge you an administration fee of fifteen (15) pounds to cover the costs of the solicitor's letter.
If you continue to withhold payment after having received reminders and demands we may have to issue legal proceedings against you. If we are forced to issue proceedings you shall be liable to pay the court fees and our solicitor's costs.
9. Additional fees for returned cheques
If you offer to settle your bill by sending us a cheque and the cheque is subsequently returned to us unpaid, we may charge you an administration fee of fifteen (15) pounds to cover the costs we have incurred as a result of you not honouring your payment.

The first copy of a deed poll costs £5.00
The second copy of a deed poll costs £7.00
The third copy of a deed poll costs £9.00
The fourth copy of a deed poll costs £11.00
The fifth copy of a deed poll costs £12.00
The sixth copy of a deed poll costs £13.00
The seventh copy of a deed poll costs £14.00
The eighth copy of a deed poll costs £14.50

11. Our right to refuse an order
No contract shall exist between you and us until we have signalled our acceptance of your offer to purchase goods or services from us. We reserve the absolute right to refuse to accept any order for any reason. In the event that we are unwilling to accept your order you will be notified of this and any money you have already paid us in relation to the order will be refunded to you.
12. Your right to cancel this contract
Under the Consumer Protection (Distance Selling) Regulations 2000 (the "Regulations") you are entitled to cancel your order and terminate this contract within seven (7) days of submitting it.
However as we process all orders before the expiration of the seven (7) day cancellation window and deed polls are personalised to your requirements, the Regulations limit your ability to cancel your order and terminate this contract to the time between submitting the order and us beginning to prepare your deed poll.
If your cancellation request is received before we begin to process your order you will receive a refund of any money already paid in relation to the order.
13. Correction of errors
In the event that an error (typographical or otherwise) appears on your deed poll, it will be handled in the following way:
13.1 If the error is our fault
If the error appears on your deed poll as a result of a mistake which is our responsibility, we will issue a replacement deed poll and send it to you by first class mail on the same day we acknowledge the error without charge. This is the limit of our liability.
13.2 If the error is your fault
If the error appears on your deed poll as a result of a mistake which is your responsibility (you spelt your name wrong on the order form, for example), we will issue a replacement deed poll and send it to you by first class mail within three days of us acknowledging the error. There will be a charge of ten (10) pounds payable for this.
14. Replacing missing orders
If your order has not arrived within seven (7) days of dispatch you will be entitled to receive a replacement order which will be sent out within three (3) days of us acknowledging the issue. You will not be entitled to a refund of any part of your payment as a result of your order going missing while in transit. There is no charge for the replacement documents and this is the limitation of our liability.
15. Payment of refunds
If you are entitled to receive a refund under the terms of this agreement we will process the refund within thirty (30) days of us acknowledging your entitlement.
16. Discounts
From time to time you may be offered a discount on the cost of your order. If you fail to pay for your order within the time limit prescribed by section seven (7) above, you shall forfeit the discount and the original non-discounted total will be due.
17. Severability
If any of these terms is at any time held in any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.
18. Governing law
This agreement is governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the English Courts.
